Haunted House Creations – Terms & Conditions

Thank you for choosing Haunted House Creations. Many of our products are handmade, custom-built, modified, or produced to order. By placing an order with Haunted House Creations, you acknowledge and agree to the following Terms & Conditions.
1. Orders & Payment
Orders are considered confirmed once payment, or any required deposit, has been received.
Customers are responsible for reviewing their order details and ensuring that the products, options, quantities, shipping information, and other requested specifications are correct before submitting an order.
Because many Haunted House Creations products are handmade or built to order, production may begin shortly after an order is received.
2. Order Cancellations – 3% Cancellation Fee
Orders canceled at the customer's request, for reasons not caused by Haunted House Creations, will be subject to a 3% cancellation fee based on the total amount paid.
This fee helps cover non-refundable payment processing and administrative costs associated with the original transaction and cancellation.
If an order is canceled by Haunted House Creations, or if the cancellation is required because we are unable to fulfill the order as agreed, the 3% cancellation fee will not apply.
Once production has begun on a custom, made-to-order, or specially modified product, additional cancellation restrictions or charges may apply.
3. Custom & Made-to-Order Products
Many Haunted House Creations products are manufactured, assembled, painted, programmed, modified, or configured specifically for an individual customer.
Once work has begun on a custom or made-to-order product, the order may not be eligible for cancellation or refund.
If we agree to cancel an order after production has begun, any refund may be reduced by the cost of materials, components, labour, custom work, and other expenses already incurred in producing the order.
Custom finishes, modifications, programming, special configurations, and other customer-requested changes may be non-refundable.
4. Changes to an Order
Please contact Haunted House Creations as soon as possible if you need to change an order.
We will make reasonable efforts to accommodate changes before production begins. Once production has started, requested changes may result in additional charges and may affect the estimated completion date.
Changes cannot always be accommodated after production has begun.
5. Production & Lead Times
Any production or completion dates provided by Haunted House Creations are estimates unless specifically stated otherwise in writing.
Because our products may involve handmade fabrication, electronics, mechanical components, painting, programming, and third-party components, unexpected delays can occasionally occur.
We will make reasonable efforts to complete orders within the estimated timeframe and communicate significant delays when they occur.
6. Handmade Product Variations
Many Haunted House Creations products are handmade and individually finished.
Small differences in colour, texture, paint, weathering, sculpting, assembly, or other cosmetic details are normal and are part of the nature of a handmade product.
These reasonable variations are not considered defects.
7. Shipping
Customers are responsible for providing a complete and accurate shipping address.
Haunted House Creations is not responsible for delays caused by shipping carriers, customs authorities, weather, incorrect addresses, or circumstances outside our reasonable control.
International customers are responsible for any applicable customs duties, import taxes, brokerage fees, VAT, or other charges imposed by their country unless otherwise specifically stated.
8. Shipping Damage
Customers should inspect their shipment promptly after delivery.
If a product arrives damaged, please contact Haunted House Creations as soon as reasonably possible and provide photographs of:

The shipping label

The damaged product
Please retain the original packaging until the shipping claim has been resolved.
We may require photographs, video, or other information to determine whether damage occurred during shipping and to assist with a carrier claim.
9. Returns
Because many Haunted House Creations products are handmade, custom-built, or made to order, returns are not automatically accepted.
Please contact us before returning any product.
Products returned without prior authorization may be refused.
Any approved return must be packaged appropriately and returned in the condition specified by Haunted House Creations.
Unless the return is the result of an error by Haunted House Creations or a confirmed product defect covered by warranty, shipping costs associated with a return are the customer's responsibility.
10. Warranty
Warranty coverage varies depending on the product and components supplied.
Our warranty generally covers defects in materials or workmanship under normal intended use during the applicable warranty period.
Warranty coverage does not include damage resulting from misuse, improper installation, incorrect electrical connections, improper power supplies, physical damage, unauthorized modifications, water or environmental exposure where the product is not designed for such exposure, or operation outside the product's intended use.
Proof of purchase may be required for warranty service.
Haunted House Creations may, at its discretion and as permitted by applicable law, repair or replace a defective component or product covered under warranty.
11. Modified or Unlocked Controllers
Certain products may be supplied with controllers that have been modified, reconfigured, unlocked, or otherwise changed from the manufacturer's standard configuration at the customer's request.
Where a customer orders a product with such a modification, including a ServoDMX controller supplied with additional channels unlocked, the customer acknowledges that the original manufacturer's warranty on that controller may be void.
Any such modification will be identified where applicable.
Haunted House Creations does not represent that a manufacturer's warranty remains valid after a modification that the manufacturer considers to void its warranty.
12. Installation & Customer Modifications
Customers are responsible for properly installing, mounting, connecting, and operating Haunted House Creations products according to the supplied instructions and their intended purpose.
Modifications performed by the customer or a third party may affect or void warranty coverage.
This includes, but is not limited to, alterations to wiring, electronics, servos, controllers, mechanical assemblies, programming, power supplies, structural components, or safety-related components.
If you are unsure about a modification or installation, please contact Haunted House Creations before making the change.
13. Animatronic Products
Animatronics contain moving mechanical components.
Customers are responsible for installing and operating animatronic products in a manner that prevents guests, employees, children, animals, clothing, hair, or other objects from coming into contact with moving mechanisms.
Animatronics should be securely mounted and operated only within their intended specifications.
Do not operate a product if mechanical or electrical damage is suspected.
14. Electrical Equipment
Only the specified voltage and appropriate power supply should be used with Haunted House Creations products.
Damage resulting from incorrect voltage, reversed polarity, improper wiring, unsuitable power supplies, short circuits, or unauthorized electrical modifications is not considered a manufacturing defect.
Where installation requires electrical work beyond normal plug-in connections, installation should be performed by a person appropriately qualified for that work.
15. Intended Use
Unless otherwise specified, Haunted House Creations animatronics and props are intended primarily for entertainment and display purposes, including haunted attractions, escape rooms, themed entertainment, amusement attractions, displays, and similar applications.
Products should not be used for any purpose for which they were not designed.
16. Product Images & Descriptions
We make reasonable efforts to accurately represent our products through photographs, videos, descriptions, specifications, and measurements.
Because products may be handmade and because designs may be improved over time, minor cosmetic or component differences may occur.
Any substitution will be intended to maintain comparable functionality and quality.
17. Replacement Parts & Repairs
Where practical, Haunted House Creations may offer replacement components, repair services, or technical assistance for our products.
Availability and pricing of replacement parts are not guaranteed indefinitely and may depend on component availability from third-party manufacturers.
Repairs or replacement parts that are not covered under warranty may be subject to parts, labour, and shipping charges.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Haunted House Creations will not be responsible for indirect, incidental, special, or consequential losses arising from the use, inability to use, installation, modification, or operation of its products.
Nothing in these Terms & Conditions is intended to exclude or limit any rights or remedies that cannot legally be excluded or limited under applicable consumer protection law.
19. Customer Responsibility
By purchasing and using a Haunted House Creations product, the customer agrees to follow the supplied instructions, use appropriate safety precautions, and ensure that the product is suitable for the customer's intended application.
Commercial operators are responsible for determining and complying with any applicable workplace, electrical, fire, building, amusement, or other safety requirements for their particular installation.
20. Intellectual Property
Product designs, photographs, graphics, instructions, manuals, videos, website content, and other original Haunted House Creations materials remain the property of Haunted House Creations unless otherwise stated.
Purchase of a product does not transfer ownership of the associated intellectual property or grant permission to commercially reproduce the product or our copyrighted materials.
21. Pricing & Errors
We make reasonable efforts to ensure that prices, descriptions, specifications, and other information on our website are accurate.
If an obvious pricing, typographical, or technical error occurs, Haunted House Creations reserves the right to correct the error and contact the customer regarding the affected order, subject to applicable law.
22. Governing Law
These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
Any rights provided to consumers under applicable law continue to apply and are not intended to be waived by these Terms & Conditions.
23. Changes to These Terms
Haunted House Creations may update these Terms & Conditions periodically.
The Terms & Conditions in effect at the time an order is placed will generally apply to that order unless otherwise required by law.
